I’ve been doing estate planning in San Francisco and Sacramento for over 15 years. The longer I do it, the more I realize there are simple truths that are common to estate planning as they are common to life. The greatest estate plan, living trust or will, can fall apart if the family relationships are bad. Conversely, a mediocre estate plan, living trust or will can be adequate and fulfill its purpose if the family relationships are good. Estate planning documents, even well designed and well drafted, can’t cover over a lifetime of neglect or disfunction. But good family relationships can often cover a subpar estate plan.
